Terms of Use

1. Acceptance of Terms

By accessing, creating an account, or using the Service in any way, you agree to be bound by these Terms. If you do not agree to all of the terms and conditions, you may not access or use the Service. Your continued use of the Service constitutes your acceptance of these Terms.

2. Eligibility

You must be at least 18 years of age to use the Service. By agreeing to these Terms, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into a binding agreement.

3. User Conduct and Content Rules

You are solely responsible for your conduct and any data, text, information, and content ("User Content") that you submit, post, and display on the Service. You agree not to post User Content that:

• Is illegal, fraudulent, defamatory, hateful, harassing, or promotes violence or discrimination against any individual or group.
• Is pornographic, obscene, or otherwise morally questionable.
• Infringes upon any third party´s intellectual property rights, including copyright, trademark, or patent. You agree not to plagiarize or submit content that you do not have the right to use.
• Contains any hyperlinks, URLs, or external links of any kind within the front or back of a flashcard.
• Contains malicious code, such as viruses, trojan horses, or worms.
• Constitutes spam, "chain letters," or unsolicited commercial advertising.
• Maliciously alters, removes, or otherwise degrades the quality or quantity of content in a deck after it has been purchased by other users ("bait and switch").

4. The Flashcard Exchange

Purchases: When you purchase a deck from the Exchange, you are purchasing a license to access the specific version of the deck that is available at the time of purchase. This license is non-transferable and for your personal use.

Deck Updates: Creators may update their decks by publishing new versions. If you have purchased a previous version, you will retain access to that version. You will also be notified of the new version and given the option to add it to your account at no additional cost. The version you originally purchased will not be altered.

5. Intellectual Property

Your Content: You retain all ownership rights to the User Content you create and post on the Service. However, by posting User Content, you grant FlashcardForge a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform your User Content in connection with the Service.

Our Right to Moderate: By using the Service, you acknowledge and agree that FlashcardForge has the absolute right, in its sole discretion, to refuse, alter, edit, or delete any User Content you post, at any time, for any reason or for no reason, with or without notice.

Our Content: All content on the Service, including the design, text, graphics, logos, and software, is the property of FlashcardForge and is protected by copyright and other intellectual property laws.

6. Termination

We reserve the right to suspend or terminate your account and access to the Service at our sole discretion, without notice, for any conduct that we believe violates these Terms or is harmful to other users of the Service, us, or third parties.

7. Disclaimers and Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND.WE EXPRESSLY DISCLAIM ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL FLASHCARDFORGE, ITS OWNERS, EMPLOYEES, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE.

8. Indemnification

You agree to indemnify and hold harmless FlashcardForge and its employees from and against any and all claims, liabilities, damages, losses, and expenses, including reasonable attorneys´ fees, arising out of or in any way connected with your access to or use of the Service or your violation of these Terms.

9. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms on this page. Your continued use of the Service after any such change constitutes your acceptance of the new Terms.
